1. Definitions

  • Customer (Buyer): The individual or entity purchasing products or services through the Seller’s website.
  • Agreement: These Terms and Conditions.
  • Product/Service: Goods and services offered for sale by the Seller.

3. General Provisions

These Terms and Conditions ("Agreement") govern the relationship between the Seller and the Customer (Buyer) regarding online purchases made through the Seller’s websites: www.pardon-app.com, www.manager.pardonapp.co, and www.order.pardonapp.co. By using the website, you agree to comply with and be bound by this Agreement.

4. Subject of the Agreement

This Agreement outlines the terms and conditions for the sale and delivery of products and services provided by the Seller through the aforementioned websites in accordance with Turkish Law No. 4077 on the Protection of Consumers and the Regulation on the Procedures and Practices for Distance Contracts. Both parties acknowledge and accept these terms by engaging in online transactions.

5. Order and Payment

5.1. Placing an Order

Customers place all orders through the Seller’s websites and designated panels. Orders made via phone or other communication methods are not considered valid. Information entered during the order process will be recorded by the Seller and used for sales activities.

5.2. Payment Methods

Customers complete payment through the Seller’s affiliated payment providers upon finalizing their orders. Accepted payment methods include:

  • Credit Card
  • Bank Transfer
  • Other Specified Methods

Orders not paid within 24 hours of placement will be canceled, and the Seller will be released from the obligation to deliver the product or service. The Seller reserves the right to modify, increase, decrease, or remove payment options at any time.

6. Delivery of Goods and Provision of Services

6.1. Delivery Time and Conditions

  • Delivery Time: Products will be delivered as soon as possible after order confirmation, within the legal period of 30 days. The Seller reserves the right to extend the delivery period by an additional 10 days with written notice.
  • Delivery Location: Products will be delivered to the address specified by the Customer using a shipping company chosen by the Seller.
  • Delivery Costs: If the Seller has stated that delivery costs for orders exceeding a certain amount will be covered, the Seller will bear these costs. Otherwise, delivery fees will be the responsibility of the Customer. Delivery will occur once the product price has been credited to the Seller’s account. The Seller will use its partnered shipping companies unless the Customer requests a different carrier, in which case any additional shipping costs will be borne by the Customer.

6.2. Provision of Services

Services will be provided online through the Customer’s local servers or the Seller’s servers. Shipment of products will be handled by well-known logistics firms within the Republic of Turkey. The Seller may employ its own personnel for product shipments if deemed necessary.

7. Return and Cancellation Policy

7.1. Right of Withdrawal

The Customer has the right to withdraw from the contract within 14 days of receiving the product or service without any justification. To exercise this right, the product must be returned in its original, unused condition with all packaging and accessories intact. The Seller will cover the delivery costs for returns due to withdrawal.

7.2. Withdrawal and Return Process for Electronic Products

For electronic products, the right of withdrawal applies only if the original packaging is undamaged, and all invoices and accessories are included. Products with services installed by the Seller’s technicians cannot be returned if the packaging has been opened or installation has been carried out by unauthorized parties.

7.3. Returns Outside the Withdrawal Period

For return requests made between 6 to 14 months after purchase, the product must be sent to an authorized service center and approved for a refund by the service provider.

7.4. Order Cancellations

To cancel an order, the Customer must contact the Seller on the same day via +90 212 238 12 21.

7.5. Non-Returnable Products/Services

Custom-made products, single-use items, perishable goods, software that can be copied, and services for specific periods are not eligible for return. Additionally, promotional items or other electronic products must be returned in an unused and undamaged state. If these conditions are not met, shipping costs will be the responsibility of the Customer. Services provided will incur fees for the period used, and payments will be adjusted in the next billing cycle.

8. Intellectual Property Rights

All materials on the website (texts, graphics, logos, images, software, etc.) are owned by the Seller or its licensors. Unauthorized use is prohibited.

9. Privacy Policy

9.1. Collection of Personal Data

The Seller collects personal data with due regard for privacy. Collected data may include:

  • Identity and Contact Information: Name, surname, phone number, email address
  • User Information, Transaction Information, and Financial Information: Membership details, membership ID, dates and times of service usage, reasons for contacting the Seller, search terms and filtering preferences used within the application, ratings and reviews, product/service preferences, restaurant category visits, errors during usage, account and payment information
  • Location Information: GPS data or approximate location information obtained during service usage
  • Transaction Security Information: Login credentials, passwords
  • Marketing Information: Reports and evaluations showing habits and preferences, targeting information, cookie records, etc.
  • Complaint Management Information: Requests and complaints made through the application, evaluations shared within the application
  • Risk Management Information: IP address

9.2. Use of Data

Collected personal data may be used for:

  • Processing and delivering orders
  • Providing customer service
  • Marketing and promotional activities (with user consent)
  • Fulfilling legal obligations

Data may also be used for improving services, introducing new services, conducting business activities, and ensuring the legal and commercial security of the Seller and its partners.

9.3. Data Security

The Seller implements necessary technical and administrative measures to protect personal data from unauthorized access, including encryption and firewalls.

9.4. Data Sharing

Personal data will not be sold, rented, or shared with third parties except as required by law or for the purposes stated in this Privacy Policy.

9.5. User Rights

10. Limitation of Liability

11. Amendments

The Seller reserves the right to modify this Agreement at any time. Changes become effective upon being posted on the website. Users are encouraged to review the Agreement regularly.

12. Governing Law and Jurisdiction

This Agreement is governed by the laws of the Republic of Turkey. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the Istanbul Courts and Enforcement Offices.

14. Other Provisions
  • Amendment of Agreement: The Seller reserves the right to amend this Agreement at any time. Amendments become effective upon being posted on the website.
  • User Rights and Obligations: Users agree to comply with this Agreement and ensure that their information is accurate and up-to-date.
15. Intellectual Property

All materials on the website (texts, graphics, logos, images, software, etc.) are owned by the Seller or its licensors. Unauthorized use is prohibited.

16. Default and Legal Consequences

If the Customer defaults on credit card payments, they will be liable for interest as per the credit card agreement with their bank and responsible to the bank.

17. Implementation and Commencement of Agreement

This Agreement commences when the Customer completes an order through the Seller’s website. Failure to complete payment does not nullify the terms of this Agreement.

18. Authorized Jurisdiction

Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the Istanbul Courts.

19. Electronic Communication Consent

By accepting the order Agreement, the Customer consents to receive all future campaigns, discounts, surveys, and notifications via electronic bulletins, emails, phone calls, and SMS from the Seller.

20. Commencement of Agreement

This Agreement begins when the Customer completes an order on the Seller’s website. Incomplete payment does not nullify the terms of this Agreement.

The customer accepts, declares and undertakes that he/she has read and informed the terms of the contract together with the order agreement and has given the necessary confirmation electronically.
